These Terms of Service (“Terms”) govern your access to and use of the website https://blastpoint.com/ and any related services (collectively, the “Services”) provided by BlastPoint (“we”, “us”, “our”). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

We may modify these Terms at any time by posting the revised version on the Site and updating the “Last updated” date. Your continued use of the Services after changes constitutes acceptance of the new Terms.

a. Eligibility
You must be at least 18 years old (or the minimum age in your jurisdiction) and capable of entering into binding contracts to use the Services.
b. Account Registration (if applicable)
If registration is required, you must provide true, accurate, current information and maintain the security of your login credentials. You are responsible for all activity under your account.

You may not reproduce, distribute, modify, create derivative works of or exploit any portion of the Services without our prior written consent.

5. User Content

If you submit or share any content via the Services (for example, comments, uploads), you grant us a worldwide, royalty-free, non-exclusive, sublicensable, transferable license to use, reproduce, distribute, prepare derivative works of, display and perform the content in connection with the Services and our business. You are responsible for any content you provide and represent that you have all necessary rights to grant these licenses.

6. Disclaimers & Limitation of Liability

a. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
b. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BLASTPOINT (OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR AFFILIATES) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA OR USE, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS, IF ANY.

7. Indemnification

You agree to indemnify, defend and hold harmless BlastPoint and its officers, directors, employees, agents and affiliates from and against any and all claims, liabilities, damages, losses or expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms or your use of the Services.

8. Termination

We may suspend or terminate your access to all or part of the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Sections 4 (Intellectual Property), 5 (User Content), 6 (Disclaimers & Limitation of Liability), and 9 (Governing Law) will survive termination.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of law provisions.
